Fernable Pty Ltd ACN [pending] (“Fernable”, “we”, “us”) is committed to protecting the personal information we handle. This Privacy Policy explains what information we collect, how we use it, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

1. What Information We Collect

We collect information you provide directly and information generated through your use of the Service:

  • Account information: name, email address, organisation name, and role.
  • Shipment and trade data: exporter/importer details, product descriptions, quantities, consignee information, and related commercial documentation you enter into the platform.
  • Usage data: log files, page views, feature interactions, and session data collected automatically when you use the Service.
  • Communications: emails or messages you send to us, including support requests.

We do not intentionally collect sensitive information (as defined under the APPs) unless you voluntarily provide it.

2. How We Use Your Information

We use the information we collect to:

  • provide, operate, and improve the Service;
  • authenticate your identity and manage your account;
  • send transactional communications (confirmations, alerts, invoices);
  • send product and service updates where you have opted in or where we have a legitimate interest;
  • analyse usage patterns to improve features and reliability;
  • comply with our legal obligations and enforce our Terms of Service.

3. Disclosure of Information

We may share your information with:

  • Service providers: third-party vendors who help us operate the Service (cloud hosting, analytics, email delivery, payment processing). They are permitted to use your information only to provide services to us.
  • Business transfers: if Fernable is involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction.
  • Legal requirements: where required by law, court order, or government authority.

We do not sell your personal information to third parties.

4. Third-Party Services

The Service uses the following third-party services that may process your data:

  • Supabase (database and authentication, hosted in ap-southeast-2 / Sydney)
  • Vercel (application hosting and delivery)
  • PostHog (product analytics and session recording)
  • HubSpot (CRM and marketing communications)

Each of these providers maintains its own privacy practices. We have agreements in place to ensure appropriate data handling.

5. Data Storage and Security

Customer data is stored in Australia (Supabase ap-southeast-2 region, Sydney). We implement industry-standard security controls including encryption in transit (TLS) and at rest, access controls, and audit logging. No method of transmission over the internet is 100% secure; we cannot guarantee absolute security but we take reasonable steps to protect your information.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. After account termination we retain data for up to 30 days before deletion, unless a longer period is required by law. Anonymised or aggregated data may be retained indefinitely for analytics purposes.

7. Cookies and Tracking

We use cookies and similar technologies to authenticate sessions, remember preferences, and collect analytics data. You can control cookie behaviour through your browser settings. Disabling certain cookies may affect Service functionality.

8. Your Rights

Under the Australian Privacy Principles you have the right to:

  • access the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • make a complaint about how we handle your personal information.

9. International Transfers

Some of our service providers operate outside Australia (including the United States). Where personal information is transferred overseas we take reasonable steps to ensure it receives comparable protection to that required under Australian law.

10. Children

The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or in-app notice. The updated policy will be effective from the date shown at the top of this page.
